Terms of Service

1. Agreement
By registering for a DriveSync account, you ("Instructor", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.
2. Service description
DriveSync provides a software-as-a-service (SaaS) platform for UK Approved Driving Instructors (ADIs) offering:
- Lesson scheduling and diary management (including recurring lessons)
- Pupil management, record keeping, and reliability scoring
- Route-optimised smart booking with GREEN/AMBER scoring
- Pupil self-booking via unique PIN-protected booking links
- Email and SMS notifications (booking confirmations, reminders, daily summaries)
- Interactive route maps and travel time calculations
- Payment and expense tracking
- Mileage calculation and reporting
- Financial CSV export for tax purposes
- Cancellation policy management
- Gearbox type scheduling (manual, automatic, or both)
3. Account responsibilities
- You are responsible for maintaining the security of your account credentials.
- You are responsible for the accuracy of the data you enter into DriveSync.
- You must not share your login credentials with any other person.
- You are the data controller for your pupils' personal data. DriveSync processes this data on your behalf as a data processor (see our Data Processing Agreement).
- You must ensure you have an appropriate lawful basis for processing your pupils' personal data.
4. Subscription and billing
- Plans: Free (£0/month) and Pro (£14.99/month or £99.99/year).
- Free plan: Lesson diary, up to 3 active pupils, email notifications, mobile app.
- Pro plan: Everything in Free plus unlimited pupils, pupil self-booking, smart route scoring, interactive route map, SMS notifications, payment and expense tracking, mileage insights, and tax-ready CSV export.
- Free trial: 30-day Pro trial for new registrations, no payment card required. After the trial, your account reverts to the Free plan unless you subscribe.
- Auto-renewal: Pro subscriptions are auto-renewable. Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period.
- Payment: Payment is charged at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price. Payments are processed by Stripe (web), Apple (iOS), or Google (Android) depending on your platform. We do not store your payment card details.
- Managing subscriptions: You can manage and cancel your subscription at any time:
- On iPhone/iPad: Settings > tap your name > Subscriptions
- On Android: Google Play Store > Account > Subscriptions
- On the web: visit your Profile page at app.drivesync.live
- Cancellation: Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of your paid period, then your account reverts to the Free plan.
- Refunds: No refunds are provided for partial billing periods. For purchases made via Apple or Google, refund requests are handled by the respective platform.
- Price changes: We may change subscription prices with at least 30 days written notice. Any price changes will apply to billing periods starting after the change.
5. Acceptable use
You agree to use DriveSync only for lawful purposes. Specifically, you must:
- Be a legitimate UK driving instructor (ADI or PDI) or driving school.
- Not use the service for any unlawful purpose.
- Not attempt to access other instructors' data or accounts.
- Not abuse, overload, or interfere with the booking system or API.
- Not use automated tools to scrape or extract data from the platform.
6. Data and privacy
Your use of DriveSync is also governed by our Privacy Policy.
As an instructor, you are the data controller for your pupils' personal data. DriveSync acts as a data processor under the terms of our Data Processing Agreement.
You are responsible for ensuring your pupils are informed about how their data is used and for obtaining any necessary consent.
7. Pupil self-booking and cancellation
- Pupils can book and cancel their own lessons via a unique, PIN-protected booking link.
- Cancellations made within the instructor's configured notice period (e.g., 24 hours before the lesson) are recorded as late cancellations.
- Late cancellation and no-show counts are tracked per pupil and used to calculate a reliability score visible to the instructor.
- Instructors control their own cancellation policy window (0, 12, 24, 48, or 72 hours).
8. Financial tracking disclaimer
DriveSync provides financial tracking tools including payment recording, expense logging, mileage calculation, and CSV export. These tools are provided for convenience and record-keeping purposes only.
- DriveSync is not accounting software and does not provide accounting, tax, or financial advice.
- Instructors are solely responsible for their own tax compliance, HMRC submissions, and financial record-keeping obligations.
- Transfer mileage figures are estimated from postcode-to-postcode routing data and do not represent actual odometer readings. For official HMRC mileage records, use your vehicle's odometer readings.
- DriveSync provides an optional odometer reading feature for your convenience, but this is not a substitute for proper mileage records as required by HMRC.
9. Intellectual property
DriveSync, including its software, design, and features, is owned by Usman Ghani trading as DriveSync. All rights are reserved.
You retain full ownership of any data you enter into DriveSync. We claim no intellectual property rights over your content.
10. Limitation of liability
The DriveSync service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We are not liable for missed lessons, scheduling errors, or booking conflicts that may arise from system downtime or technical issues.
- We are not liable for incorrect or suboptimal route calculations or mileage estimates.
- Our maximum aggregate liability is limited to the total fees you have paid to DriveSync in the 12 months preceding the claim.
- We are not liable for your compliance with your own regulatory obligations (e.g., DVSA requirements, insurance, vehicle maintenance).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
11. Termination
- Either party may terminate this agreement with 30 days written notice.
- We may suspend or terminate your account immediately if you breach these Terms.
- On termination, your data will be available for export or will be deleted within 30 days of your request, except where retention is required by law (e.g., billing records retained for 6 years per HMRC requirements).
12. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales.
13. Dispute resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may submit the dispute to the courts of England and Wales.
